At Torqi, we are committed to protecting your privacy and ensuring the security of your personal information. This privacy policy outlines how we collect, use, and safeguard the data you provide, in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada and with applicable U.S. privacy laws, including the California Consumer Privacy Act (CCPA) where applicable.

1. Information We Collect

We collect the following personal information to facilitate the sale and pickup of your vehicle:

• Name
• Phone number
• Year, make, and model (YMM) of the car
• Condition of the vehicle (based on the questions you answer)
• Car location

This information is essential for generating an offer for your car and coordinating the pickup with the buyer’s tow truck driver. We do not collect or store email addresses, and we do not sell your information or take part in data brokering, telemarketing, or email marketing.

2. How We Use Your Information

We use your personal information for the following purposes:

• To calculate an offer for your vehicle.
• To communicate the offer and facilitate the sale.
• To coordinate the pickup of your vehicle by the buyer’s tow truck driver.
• To assist with any follow-up needed after the sale, such as issues with transferring vehicle ownership.
• To measure which of our ads lead to vehicle sales (see section 10).
• If your vehicle is in Canada outside Quebec, to show you Torqi ads on Google and Meta after you use our service (see section 10). You can opt out at any time.

We do not use your personal information for any other purposes unless explicitly agreed upon or required by law.

3. How We Share Your Information

We only share your phone number in the following circumstances:

• With the buyer whose offer you accept, in order to facilitate vehicle pickup and payment.
• If you reject an offer and request a callback, we may share your phone number with up to three potential buyers for negotiation purposes.
• In hashed form, with the advertising platforms named in section 10, to measure our ads and, for vehicles in Canada outside Quebec, to show you Torqi ads.

No other third parties will have access to your phone number, and we strictly avoid telemarketing practices. We never sell your information or share it for data brokering, and advertising platforms receive it only for Torqi’s own ads.

4. Retention of Your Information

We retain your personal information as long as necessary to:

• Facilitate the sale and pickup of your vehicle.
• Address any issues related to vehicle ownership transfer, which may arise up to one year after the transaction.

Once these purposes have been fulfilled, your data will be securely deleted from our system unless you request otherwise.

5. Right to Access and Correction

You have the right to access your personal information and request updates or corrections. If you wish to update any details, please contact us at support@torqi.com , and we will assist you in making the necessary changes.

6. Right to Be Forgotten

You have the right to request the deletion of your personal information at any time. To exercise this right, please email us at support@torqi.com , and we will manually remove your data from our system.

7. Data Security

We take the security of your personal information seriously. Your data is stored in a secure database, and we employ encryption and access control measures to protect it from unauthorized access. Only authorized personnel have access to your information, and we regularly review our security practices to maintain compliance with privacy regulations.

8. Your Rights

Under Canadian law and applicable U.S. law, you have the following rights regarding your personal information:

• The right to access your data.
• The right to request corrections or updates.
• The right to request the deletion of your data (right to be forgotten).
• The right to withdraw consent for the collection, use, or disclosure of your information.

9. SMS Opt-In and Messaging

If you opt in to receive text messages from Torqi, your phone number will be used to send you the messages you consented to receive, including vehicle offers, pickup coordination, and promotional updates, and may also be processed for analytics and advertising purposes as described below. You may receive between 1 and 5 SMS messages per vehicle transaction depending on activity (offers, appointment changes, reminders, and confirmations). Standard message and data rates may apply. Check with your carrier for details about rates applicable to your plan. You may opt out at any time by replying STOP. For help, reply HELP or contact support@torqi.com.

10. Mobile Number Sharing for Advertising, Analytics and Compliance

Your phone number may be processed for the following limited purposes:

• Conversion Tracking and Analytics: Your phone number may be hashed before being shared with the advertising platforms we use (Google Ads, Microsoft Advertising, Meta and ChatGPT Ads) for conversion tracking and performance measurement. This allows us to understand which of our ads lead to vehicle sales.
• Torqi Ads (Canada, outside Quebec): If your vehicle is located in Canada outside Quebec, we may share your hashed phone number with Google and Meta (Facebook and Instagram) so they can show you Torqi ads, for example a reminder about an offer you have not accepted yet. The platforms match the hashed number to their own users and use it only for Torqi’s ads. We never do this for vehicles located in Quebec or in the United States. To opt out at any time, email us at support@torqi.com, and we will remove your number from these ad audiences within 7 days. Replying STOP to our text messages also removes it.
• Transaction Facilitation: Your phone number is shared with the Recycler whose offer you accept, solely to coordinate vehicle pickup and payment. If you reject an offer and request a callback, your number may be shared with up to three potential buyers for negotiation purposes only.

We do not sell SMS opt-in data to third parties, and SMS opt-in data and consent are never shared with any third party. Except as described in this section, we do not share your mobile number with third parties or affiliates for marketing or promotional purposes, and the mobile numbers of U.S. residents are never shared for marketing or promotional purposes. No personal information collected through SMS opt-in is used for purposes beyond those described in this policy.

11. Updates to This Privacy Policy

We may update this privacy policy from time to time to reflect changes in our practices or legal requirements. Any updates will be posted on our website, and we encourage you to review this policy periodically.
